Terms of Use
These terms are an agreement between you and Continuum Company ("Continuum", "we", "us") for the use of the Haraka app on iPhone and Apple Watch. By using Haraka you accept these terms. If you do not accept them, do not use the app.
1. What Haraka is — and is not
Haraka lets you choose and configure movements, amounts, starting levels, progressions, goals, plans, schedules, reminders, timing, swaps, and rest days. It may present defaults or suggestions, but every option is optional and editable. You may accept, change, replace, postpone, or ignore any option.
Haraka is not a medical device, medical advice, or a substitute for professional care. It does not diagnose, treat, or monitor any condition, and it does not assess your health or fitness. A reminder, plan, goal, progression, streak, completion indicator, or progress display is an organizational or motivational feature only. It is not a direction, prescription, personalized fitness recommendation, safety assessment, medical advice, or confirmation that you should begin, continue, increase, or resume an activity.
2. Health disclaimer and assumption of risk
Physical activity carries risk, including the risk of injury. By using Haraka you agree that:
- you should consult a qualified physician before beginning this or any movement program, especially if you are pregnant, have a medical condition, an injury, or any doubt about your ability to exercise safely;
- you decide independently whether, when, where, and how to perform any physical activity. You are solely responsible for deciding what is safe and appropriate for you, including the movement, amount, technique, equipment, surroundings, intensity, frequency, progression, and rest;
- Haraka does not observe your technique, equipment, surroundings, physical condition, fatigue, pain, or recovery. It cannot determine whether an activity or option is safe or suitable for you;
- you will stop immediately and seek appropriate professional advice if you feel pain, dizziness, shortness of breath, or unusual discomfort. The app's "pain or unusual discomfort" option adjusts reminders; it is not a medical response and does not evaluate your condition;
- physical activity carries known and unknown risks, including injury. You voluntarily accept the risks of every physical activity you choose to perform, whether or not Haraka displayed an option, reminder, plan, goal, or other information related to that activity.
3. Who may use Haraka
You may use Haraka only if you can legally agree to these terms where you live. If you are under the age of majority, you may use Haraka only with the permission and supervision of a parent or legal guardian who accepts these terms on your behalf.
4. Your license
Your license to use Haraka is governed by Apple's Standard EULA. These terms supplement and do not replace the Apple Standard EULA. If these terms conflict with the Apple Standard EULA about the license or use of Haraka on Apple products, the Apple Standard EULA controls. Haraka, its name, design, and content remain the property of Continuum and its licensors.
5. Haraka+ subscriptions
- Haraka's core loop is free. Haraka+ is an optional auto-renewing subscription (monthly or annual) that unlocks additional features described in the app. The price and billing period are shown in the app and in the App Store for your region before you buy.
- We may offer an introductory offer, such as a free trial, on some plans. Any offer, its length, and its eligibility rules are shown in the App Store before you buy; Apple determines eligibility. If you accept a trial, your Apple Account is charged the subscription price shown when the trial ends unless you cancel at least 24 hours beforehand.
- Payment is charged to your Apple Account through the App Store. Your subscription renews automatically unless you cancel at least 24 hours before the end of the current period. You can manage or cancel it anytime in your App Store subscription settings; cancelling takes effect at the end of the current period, and deleting the app does not cancel it.
- Prices may change; the App Store will tell you and, where required, ask you to agree before a change applies to you.
- Refunds are handled by Apple under App Store policies, except where applicable law requires otherwise.
- If your subscription ends, nothing is deleted. Your data and settings are kept on your device; premium features pause, and your configuration is restored if you re-subscribe. Where a paused plan involves suggested movement levels, Haraka may ask you to confirm your level when it resumes.
6. Your data and your responsibility for backups
Haraka stores your data only on your devices and has no server copy — see the Privacy Policy at haraka.continuum.sa/privacy, which is part of these terms. You are responsible for backing up your device. If you lose your device or delete the app without a backup, we cannot recover your Haraka data, because we never had it.
7. Apple Health
If you enable the optional Health mirror, Haraka writes your completed movement snacks to Apple Health and deletes the corresponding record if you delete the log. Haraka never reads Apple Health data. Your use of Apple Health is also governed by Apple's terms.
8. Acceptable use
You agree not to misuse Haraka, interfere with its operation, or use it in violation of applicable law or App Store terms.
9. Changes to the app and these terms
We may update, change, or discontinue features of Haraka. If we materially change these terms, we will update the effective date and version above and present the change clearly; continuing to use the app after a change takes effect means you accept the updated terms.
10. Disclaimer of warranties
Haraka is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted or error-free, that reminders will always be delivered — notification delivery depends on your device and iOS — or that any fitness outcome will be achieved.
Notifications may be delayed or not delivered. Logs, progress information, Watch synchronization, and Apple Health records may be incomplete, delayed, duplicated, or unavailable. Do not rely on Haraka to monitor your health, supervise activity, provide an emergency response, or tell you when to exercise, rest, seek care, or stop.
11. Limitation of liability
To the fullest extent permitted by law, Continuum is not liable for injury, loss, or damage arising from physical activity you choose to perform; the way you perform it; your equipment or surroundings; or your decision to use, change, postpone, replace, ignore, or rely on any option or information displayed by Haraka. Continuum will not be liable for any indirect, incidental, special, consequential, or exemplary damages, or for loss of data, arising from your use of Haraka. Continuum's total aggregate liability for all claims relating to Haraka will not exceed the amount you paid for Haraka+ during the 12 months before the event giving rise to the claim. Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited.
12. Termination
You may stop using Haraka at any time by deleting the app. We may terminate or suspend this license if you materially breach these terms. Sections 2, 6, and 10–15 survive termination.
13. Apple-specific terms
These terms are between you and Continuum, not Apple. Apple has no obligation to provide maintenance or support for Haraka and is not responsible for addressing any claim relating to the app, including product liability, regulatory, or intellectual-property claims. In case of Haraka's failure to conform to a warranty, you may notify Apple for a refund of the purchase price (if any); Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You represent that you are not located in a country subject to a U.S. government embargo and are not on any U.S. government restricted-party list.
14. Governing law
These terms are governed by the laws of the Kingdom of Saudi Arabia. To the fullest extent permitted by law, the competent courts of the Kingdom of Saudi Arabia have exclusive jurisdiction over any dispute relating to Haraka or these terms. Nothing in this section removes any mandatory right you may have to bring a claim in another court.
15. General
If any part of these terms is found unenforceable, the rest remains in effect. These terms and the Privacy Policy are the entire agreement between you and Continuum regarding Haraka, except for the Apple Standard EULA, which governs the app license as described in section 4.
